Consent

These Terms and Conditions (“Terms”) apply to the use of our website and/or games (“Services”) provided by Happy Alpaca (“Happy Alpaca”, “We” or “Our”) and govern your relationship with us regarding the use of our Services. By downloading, installing, accessing or using any part of the Services you agree to these Terms. Use of our Services is also governed by our Privacy Policy.

Before accessing or using any of our Services, you must agree to these Terms and our Privacy Policy. By using the Services you represent that you are age 13 or older. If you are between the ages of 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms and that they are happy to give you permission to access these Services.

License and limitations

When you agree to these Terms, Happy Alpcaca grants you a personal, non-sublicensable limited license to access and use the Services for your own non-commercial entertainment purposes. You agree not to use the Services for any other purpose.

You agree that you will not:

  • Sell access to the Services to others, or use parts of the Services for your own commercial activities;
  • Use the Services for fraudulent or abusive purposes in any way, or otherwise misrepresent Happy Alpaca or its Services in any way;
  • Attempt to decompile, reverse engineer, disassemble or hack any of the Services, try to overcome any of the encryption technologies or security measures of the Services or try to tamper with data transmitted, processed or stored by the Services;
  • Disrupt the normal flow or game mechanics of the Services or otherwise act in a manner that Happy Alpaca deems not to be within the intent of the Services.

Happy Alpaca reserves the right to stop offering and/or supporting the Services or part of the Services at any time, at which point your license to use the Services will be automatically terminated. In such event, Happy Alpaca shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued services.

Intellectual Property Rights

All rights, title and interest in and to the Services (including without limitation any games, titles, computer code, artwork, sounds, musical compositions, audio-visual effects) are owned by or licensed to Happy Alpcaca, and are subject to copyright and other intellectual property rights.

Purchases Terms

In the Services you may purchase, with “real world” money, a limted, personal, non-transferable licene to use “virtual currency”, which you may use to purchase “virtual in-game items” (together with “virtual currency”, “Virtual items”) in the Services. All purchases of virtual items made through the Services are final and non-refundable. Happy Alpcaca may manage, modify or eliminate Virtual Items at any time, with or without notice. Happy Alpaca shall have no liability to you or any third party in the event that Happy Alpaca exercices any such rights.

Beta tests

Happy Alpcaca may offer to you a chance to participate in beta tests (open or closed) of certain parts of the Services. Your participation into such beta tests may be subject to separate terms, such as a non-disclosure agreement.

By applying to and/or participating in beta tests you acknowledge and accept that:

  • Due to the unfinished and experimental nature of the beta tested parts of the Services, you understand that parts of the Services may be nonfunctional and providing feedback about this to Happy Alpaca is the intent of the beta test.
  • Any in-app purchases of Virtual Items may be periodically reset by Happy Alpaca during the course of the beta tests. Happy Alpaca offers no refunds for any such lost content.
  • Any feedback, ideas or created material submitted by you to Happy Alpaca regarding the beta tested parts of the Services may be utilized by Happy Alpaca without any compensation to you. By submitting feedback, ideas or created material regarding beta tested parts of the Services you grant to Happy Alpaca an unlimited and transferable license to utilize such feedback, ideas or created material in its Services.
  • Your application to participate in beta tests doesn not entitle you to be invited to, or to participate in any beta test offered by Happy Alpaca.

Personal data and Security

Happy Alpaca’s use of your personal data is governed by our Privacy Policy. You approve to the processing of your personal data in accordance with the Privacy Policy by downloading, installing, accessing or using the Services.

Disclaimer of Warranties

Our Services are provided on an “as is” basis for your use, without warranties of any kind, including without limitation the warranties on merchantabilty, fitness for any particular purpose, well-functioning of services, availability of Services or parts of Services, including without limitation in-game progress, Virtual Items or other in-game data. Happy Alpaca shall not be liable to you for any indirect, incidental, consequential or other similar damages, including but not limited to loss of revenues, lost data or other intagible losses, arising out of or relating in any way to these Terms or the Services.

Changes to our Terms and Conditions

We reserve the right to make changes to these Terms at any time. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately, after they are posted on this page. Your continued use of the services will be deemed to confirm your acceptance of the updated Terms.
